IMPORTANT: Please read carefully. This agreement affects legal rights. Electronic acceptance through PEAK’s registration/CRM
system is intended to have the same effect as a handwritten signature, to the extent permitted by applicable law.

1. ACKNOWLEDGMENT AND ASSUMPTION OF RISK

I understand that pickleball, athletic training, conditioning, drills, camps, clinics, lessons, tournaments, recreational activities, excursions, and
travel-related activities involve inherent and other risks. These may include falls; collisions; being struck by a ball, paddle, person, or object;
strains; sprains; fractures; head injury; dehydration; heat illness; cardiac events; illness or communicable disease; aggravation of pre-existing
conditions; and other serious injury, disability, or death. Destination vacations may also involve transportation, lodging, excursions, weather,
terrain, food, unfamiliar facilities, delays, cancellations, and other circumstances outside PEAK’s control. I knowingly and voluntarily assume
these risks, whether known or unknown, foreseeable or unforeseeable, to the fullest extent permitted by law.

2. RELEASE AND WAIVER OF LIABILITY

In consideration for being permitted to participate, I release, waive, and discharge PEAK Pickleball Performance and its owners, officers,
coaches, instructors, employees, independent contractors, representatives, volunteers, agents, affiliates, successors, and assigns (“PEAK
Released Parties”) from claims arising out of or related to my participation, including claims based on ordinary negligence, to the fullest extent
permitted by applicable law. This release does not apply to gross negligence, reckless or intentional misconduct, or any liability that cannot
legally be waived.

3. HOST FACILITIES AND PROPERTY RELEASE

PEAK programs may occur at courts, clubs, schools, parks, recreation centers, resorts, hotels, fitness facilities, or other properties PEAK does
not own or control. To the fullest extent permitted by law, I also release the owners, operators, managers, employees, agents, and
representatives of those host facilities and properties from claims arising from my participation or presence there, including claims involving
ordinary negligence. A host facility may require its own separate waiver or rules.

4. FITNESS, HEALTH AND SAFETY

I represent that I am physically capable of participating in the activities I choose. I am responsible for determining whether any medical condition,
injury, medication, limitation, or other circumstance affects my ability to participate safely and for seeking medical advice when appropriate. I
agree to follow reasonable safety instructions and understand PEAK may restrict or discontinue my participation when PEAK reasonably believes
continued participation presents a significant safety concern.

5. EMERGENCY MEDICAL AUTHORIZATION

If I become injured or ill and cannot make medical decisions, I authorize PEAK personnel to obtain or arrange reasonable emergency medical
assistance for me. I understand PEAK does not provide health or medical insurance for participants and I accept responsibility for costs of
ambulance service, hospitalization, treatment, medication, or other healthcare provided to me.

6. DESTINATION VACATIONS AND THIRD-PARTY SERVICES

For destination vacations, I understand airlines, hotels, resorts, transportation companies, restaurants, tour or excursion operators, sports
facilities, and other third parties may provide services independently of PEAK. PEAK does not control or guarantee their acts, omissions,
schedules, safety practices, service quality, cancellations, delays, or operations. I accept ordinary travel risks and understand separate provider
terms, waivers, insurance requirements, and cancellation policies may apply.

7. PERSONAL PROPERTY

I am responsible for my equipment, luggage, money, electronics, jewelry, vehicles, paddles, and other personal property. To the fullest extent
permitted by law, PEAK is not responsible for property that is lost, stolen, misplaced, or damaged during a PEAK activity or destination vacation.

8. PHOTO, VIDEO, AUDIO AND LIKENESS RELEASE

If I select “I CONSENT” below, I authorize PEAK to photograph, video record, audio record, and otherwise capture my image, likeness, voice,
and participation. I grant PEAK permission to edit, reproduce, publish, display, distribute, and use those materials for legitimate business,
educational, and promotional purposes, including PEAK’s website, social media, advertising, brochures, flyers, presentations, email, and digital
or print marketing, without compensation to me. I understand public internet/social-media use may be viewed or shared by others.

9. REVIEWS, TESTIMONIALS AND PARTICIPANT COMMENTS

If I select “I CONSENT” below, I authorize PEAK to quote, reproduce, publish, and display reviews, testimonials, feedback, or comments that I
voluntarily provide about PEAK programs, including on PEAK’s website, social media, advertising, brochures, email, and other promotional
materials. PEAK may make minor edits for length, spelling, grammar, or clarity without materially changing the meaning. My first name and last
initial may be used with the testimonial unless I request that it be anonymous. This permission does not authorize PEAK to disclose private
medical, payment, or other confidential information.

10. INDEMNIFICATION

To the fullest extent permitted by law, I agree to indemnify and hold harmless the PEAK Released Parties from claims, damages, or expenses
caused by my own negligent, reckless, or wrongful conduct during my participation.

11. SEVERABILITY AND APPLICABLE LAW

If any provision is found invalid or unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law. This
agreement will be interpreted only to the extent permitted by applicable law.

12. ACKNOWLEDGMENT AND ELECTRONIC SIGNATURE

I acknowledge that I have read and understand this entire agreement, have had the opportunity to ask questions, and voluntarily agree to its
terms. I understand I am assuming risks and waiving certain legal rights. By typing or electronically applying my name/signature and submitting
my registration, I intend to sign this agreement electronically and agree that the electronic record may be retained by PEAK as evidence of my
acceptance.
